Foundation and other types of underground construction are fraught with uncertainty even when a site has been investigated with the normal standard of care. This gives rise to the common construction claim for extra compensation due to changed conditions. However, in some cases this claim is made when it is unjustified. Therefore there is often considerable disagreement between owner and contractor as to what constitutes a legitimate claim for changed conditions. In such cases an expert, independent, outside assessment is required.

A contractor hired to construct footing foundations encountered ground water several feet higher than the depths shown on borings included with the contract documents. This severely impacted the planned construction process. We were retained by the contractor and were able to show that the higher ground water was due to seasonal variations not indicated in the contract documents. This represented a changed condition and the contractor was able to receive additional compensation.

A contractor was awarded a contract to rebuild a marine facility in a large east coast city. However, the original piling system design provided to him was rather expensive and we were hired to review the design for potential improvements and cost savings. We were able to work with the contractor to develop an alternative piling system for the facility that resulted in significant savings and increased profit for the contractor.
